A real estate agent in Luxembourg who builds the yield model before the mandate.
Real estate brokerage is a regulated commercial activity in Luxembourg. I hold business permit 10077275 / 1 for the activity of agent immobilier and business permit 10077275 / 2 for apporteur d'affaires immobilier, both issued by the Ministry of the Economy and listed in the public register. I take sale and letting mandates, run acquisition searches for investors and introduce qualified deals, with the yield model built by the person who will also file the accounts.

Which business permits this service relies on. The Luxembourg business permit (autorisation d'établissement, Niederlassungsgenehmigung) is the authorisation required under the amended law of 2 September 2011 to carry out a commercial, craft or liberal activity. It is granted by the Ministry of the Economy to a named person who must direct the business in a real, effective and permanent way. This service relies on the following activities, listed in the public register:
- 10077275 / 1 — Real estate agent (issued 25/03/2025)
- 10077275 / 2 — Real estate business introducer (issued 25/03/2025)
What “real estate agent in Luxembourg” means in practice
A Luxembourg property transaction is rarely only a property question. For a non-resident owner, an investor or a cross-border seller, the decisive variables are the net yield after charges and tax, the vehicle that holds the asset, and the timing with the notary. Most brokers stop at the price. The consequences continue for years in the accounts: a holding structure chosen too late, a charge regularisation nobody budgeted, a vacancy assumption that was never written down. The price is one line in the model. It is not the model.
The permit matters because the activity is regulated. Anyone can forward a listing. Only a person who has satisfied the Ministry of the Economy on professional integrity, qualification and a real establishment in Luxembourg holds a business permit for the activity of agent immobilier. The same person is a professional under the anti-money-laundering law of 12 November 2004, supervised by the AED, which is why I identify the seller, the buyer and their beneficial owners before a mandate is signed and not after an offer is accepted. Both permits can be checked by anyone in the public register before the first conversation.
Agent, introducer, notary, accountant: who does what
A Luxembourg transaction involves four professionals with four different perimeters. Knowing which one a step belongs to is part of the service.
- Agent immobilier (real estate agent). Intermediation in the sale, purchase and letting of real estate, under a business permit from the Ministry of the Economy. Valuation note, marketing, qualification of buyers or tenants, negotiation, coordination to the deed. This is the activity covered by permit 10077275 / 1.
- Apporteur d'affaires immobilier (business introducer). A distinct regulated activity. The introducer connects and qualifies; the transaction remains with the mandated parties. Covered by permit 10077275 / 2, always under a written introduction agreement.
- Notary. Every transfer of Luxembourg real estate is executed by notarial deed. The notary drafts and receives the deed, handles the registration duties and, with the tax adviser, the VAT position on new buildings. I prepare the timeline and track the conditions precedent; I do not draft the deed and I quote no rates.
- Accountant and tax adviser. The yield model, the holding vehicle and the post-transaction accounting are produced under permit 10077275 / 0. Binding tax opinions and legal advice stay with the tax adviser and the avocat.
What I do not do is as clear: no investment advice, no fund or portfolio management, no activity that requires a CSSF licence. A property file is a transaction file, not a financial product.
A mandate, as I run it
Title, existing leases, charges, co-ownership accounts where relevant, and identification of the owner and beneficial owners under the AML law. Written valuation note with the comparables used.
KYC · valuation noteMarketing file, buyer or tenant filtering on documented criteria, qualified shortlist. Visits only with parties whose capacity to close has been checked.
Marketing file · shortlistNegotiation record, offer summary with the conditions attached, and a yield check against the model before the owner accepts.
Offer summaryNotary timeline with the conditions precedent tracked, coordination between seller, buyer, bank and notary, then a post-transaction accounting and tax handover.
Notary · handoverThe timeline is delivered in writing at the start of the mandate, with the owner of each step named. For an acquisition search, the same sequence runs in reverse: a written search perimeter first, then a yield model per shortlisted asset, then the offer.
Three typical situations
Sale or letting mandate
- Written valuation note with the comparables used
- Marketing file and qualified shortlist
- Negotiation record and offer summary
- Notary timeline with the conditions precedent tracked
Acquisition search for investors
- Written search perimeter
- Yield model per asset, assumptions stated separately
- Holding vehicle reviewed with the accountant and the tax adviser
- Offer and deed coordination
Qualified deal introduction
- Introduction agreement with a non-circumvention clause where relevant
- Written qualification note per opportunity
- Dated traceability of each introduction
- Fee event defined before any name is exchanged
An investor, a bank or a tax adviser reads one thing first: the net yield after charges, vacancy and tax, under the vehicle that will actually hold the asset. A gross yield on a listing is free and means little. A written model that the accountant will later have to defend in the annual accounts is the document that survives the transaction.
What my business permit covers, and what stays outside
What I do not accept
- A mandate where the seller's title or the buyer's beneficial owners cannot be documented to the anti-money-laundering standard.
- A valuation note written to a price decided beforehand.
- An introduction made before the introduction agreement is signed.
- A “net yield” presented to an investor without the charges, vacancy and tax lines behind it.
- A commission or fee quoted before the file has been read.
